1. Agreement to Terms

Welcome to KomFirst! These Terms of Service ("Terms") govern your access to and use of the KomFirst mobile application ("App") and related services provided by KomFirst ("we," "our," or "us").

By downloading, installing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App.

2. Eligibility

To use KomFirst, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the App under applicable laws
• Provide accurate and complete registration information

If you are using the App on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration

To access certain features of the App, you must create an account. When creating an account:

• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

4. Use of the App

4.1 Permitted Use

You may use KomFirst for the following purposes:

• Discovering and connecting with local businesses
• Registering and managing your business listing
• Accessing community directories and contact information
• Communicating with businesses through provided contact methods

4.2 Prohibited Activities

You agree NOT to:

• Use the App for any unlawful purpose or in violation of any laws
• Provide false, misleading, or fraudulent information
• Impersonate any person or entity, or misrepresent your affiliation
• Harass, abuse, threaten, or intimidate other users
• Post or transmit spam, unsolicited advertising, or promotional materials
• Upload viruses, malware, or other malicious code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the App's functionality or servers
• Scrape, collect, or harvest data from the App without permission
• Use automated tools or bots to access the App
• Violate the intellectual property rights of others
• Post content that is defamatory, obscene, or offensive

5. Business Listings

5.1 Listing Requirements

If you register a business on KomFirst:

• You represent that you are authorized to list the business
• All information provided must be accurate and current
• You must have the right to use any images, logos, or content uploaded
• You are responsible for keeping your listing information up to date

5.2 Verification

We may require verification documents to confirm business legitimacy. We reserve the right to:

• Request additional documentation at any time
• Reject or remove listings that fail verification
• Mark verified businesses with verification badges

5.3 Content Standards

Business listings must not contain:

• False or misleading claims about products or services
• Content that violates any applicable laws or regulations
• Infringing, offensive, or inappropriate material
• Contact information for businesses you do not own or operate

6. User Content

6.1 Your Content

You retain ownership of content you submit to the App. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content for the purpose of operating and promoting the App.

6.2 Content Moderation

We reserve the right to review, edit, or remove any content that:

• Violates these Terms
• Is reported by other users
• We deem inappropriate or harmful

7. Intellectual Property

The App, including its design, features, content, logos, and trademarks, is owned by KomFirst and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our proprietary content
• Use our trademarks without written permission
• Reverse engineer or decompile the App
• Create derivative works based on the App

8. Third-Party Services

The App may contain links to third-party websites, services, or content. We are not responsible for:

• The availability or accuracy of third-party services
• The content or practices of third-party websites
• Any transactions you conduct with third parties

Your use of third-party services is at your own risk and subject to their terms and conditions.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• The information provided by businesses is accurate or reliable
• Any defects will be corrected
• The App will meet your specific requirements

We are a platform that connects users with businesses. We are not responsible for the quality, safety, or legality of products or services offered by businesses listed on our App.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOMFIRST AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Damages arising from your use of or inability to use the App
• Actions or content of third parties or other users

Our total liability for any claims arising from these Terms shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless KomFirst and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit to the App

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the App will immediately cease
• We may delete your account and associated data
• Provisions that by their nature should survive termination will remain in effect

You may terminate your account at any time by contacting us or using the account deletion feature in the App.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last updated" date at the top
• We may notify you through the App or via email for significant changes
• Continued use of the App after changes constitutes acceptance

If you do not agree to the modified Terms, you must stop using the App.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be:

• First attempted to be resolved through informal negotiation
• Subject to binding arbitration if informal resolution fails
• Governed by the laws of India

You agree to waive any right to participate in class action lawsuits against us.

15. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and KomFirst regarding the App.
• Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
• Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
• Assignment: You may not assign your rights under these Terms without our consent.
